Welcome to Kiki's Way. Throughout these terms, "we," "us," and "our" refer to Kiki's Way. We operate this website and online store, including all related content, features, tools, products, and services, to provide you with a thoughtfully curated shopping experience (collectively, the "Services"). Our store is powered by Shopify, which enables us to deliver the Services to you.
The following terms and conditions, along with any policies referenced within them (these "Terms of Service" or "Terms"), outline your rights and responsibilities when using the Services.

We make every effort to display our products and services accurately in our online store. However, colors and appearance may vary slightly from what you see on screen due to differences in device type, settings, and configuration.
We do not guarantee that the appearance or quality of any product or service you purchase will match your expectations or appear exactly as depicted in our store.
All product descriptions are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time and may limit quantities available to any person, geographic region, or jurisdiction on a case-by-case basis.
Section 3 – Orders
Placing an order constitutes an offer to purchase. Kiki's Way reserves the right to accept or decline any order at its discretion. Your order is not considered accepted until we confirm acceptance, which requires that we first receive and process your payment. Please review your order carefully before submitting, as we may not be able to accommodate cancellation requests once an order has been accepted. If we are unable to accept, need to modify, or cancel an order, we will make reasonable efforts to notify you using the email or billing address provided at the time of purchase.
All purchases are subject to return or exchange solely in accordance with our Refund Policy.
You confirm that your purchases are intended for personal or household use and not for commercial resale or export.
Section 4 – Prices and Billing
Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time your order is placed, as reflected in your order confirmation email. Unless otherwise stated, listed prices do not include applicable taxes.
Prices shown in our online store may differ from those offered by third-party retailers. We may occasionally offer promotions on the Services that affect pricing and are governed by their own separate terms. In the event of a conflict between promotional terms and these Terms, the promotional terms will take precedence.
You agree to provide current, complete, and accurate purchase, payment, and account information for all transactions. You also agree to promptly update your account details, including your email address, so we can complete your orders and contact you as needed.
You represent and warrant that (i) the payment information you provide is true, correct, and complete; (ii) you are authorized to use the selected payment method; (iii) charges you incur will be honored by your payment provider; and (iv) you will pay all charges at the posted prices, including applicable taxes.
Section 5 – Shipping and Delivery
We are not liable for shipping or delivery delays. All estimated delivery times are provided for reference only and are not guaranteed. We are not responsible for delays caused by shipping carriers or circumstances beyond our control. Once products are transferred to the carrier, title and risk of loss pass to you.
Section 6 – Intellectual Property
Our Services — including all trademarks, branding, text, displays, images, graphics, product reviews, video, and audio content, along with their design, selection, and arrangement — are owned by Kiki's Way, its affiliates, or licensors and are protected by U.S. and international intellectual property laws.
These Terms permit you to use the Services for personal, non-commercial purposes only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Services without our prior written consent. Nothing in these Terms grants or should be interpreted as granting you a license or other rights under any patent, trademark, copyright, or other intellectual property of Kiki's Way, Shopify, or any third party. Unauthorized use of the Services may violate applicable intellectual property laws. All rights not expressly granted are reserved by Kiki's Way.
The names, logos, product names, service names, designs, and slogans of Kiki's Way are trademarks of Kiki's Way or its affiliates or licensors. You may not use these marks without prior written permission. Shopify's name, logo, and associated marks are trademarks of Shopify. All other names, logos, and marks appearing on the Services belong to their respective owners.
Section 7 – Optional Tools
We may provide access to third-party tools as part of the Services, over which we have no monitoring, control, or input.
You acknowledge that such tools are provided on an "as is" and "as available" basis, without warranties, representations, or conditions of any kind and without endorsement. We bear no liability arising from your use of any optional third-party tools.
Your use of any optional tools is entirely at your own risk. You should familiarize yourself with and accept the terms set by the relevant third-party provider before use.
We may introduce new features through the Services in the future, including new tools and resources. Any such additions will be considered part of the Services and subject to these Terms.
Section 8 – Third-Party Links
The Services may include materials and links to websites operated by third parties, including embedded third-party content. We are not responsible for evaluating the content or accuracy of any third-party materials or websites. If you choose to leave the Services to access them, you do so at your own risk.
We are not liable for any harm or damages arising from your access to third-party websites or from any products, services, resources, or content you obtain through them. Any complaints, claims, or concerns regarding third-party offerings should be directed to the relevant third party.
Section 9 – Relationship with Shopify
Kiki's Way is powered by Shopify, which enables us to deliver the Services. However, all sales and purchases made in our store are conducted directly with Kiki's Way. By using the Services, you acknowledge that Shopify is not responsible for any aspect of transactions between you and Kiki's Way, including any injury, damage, or loss related to purchased products or services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from your purchases and transactions with Kiki's Way.
Section 10 – Privacy Policy
All personal information collected through the Services is subject to our Privacy Policy, and certain data may also be subject to Shopify's Privacy Policy. By using the Services, you confirm that you have read and understand these privacy policies.
Because the Services are hosted by Shopify, Shopify collects and processes personal information related to your access and use of the Services in order to provide and improve them. Information you submit may be transmitted to and shared with Shopify as well as third parties located in countries other than your own, in order to deliver our services. If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, or other content (collectively, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback in any medium and for any purpose, including commercial use.
You represent and warrant that (i) you own or hold all necessary rights to the Feedback you submit; (ii) you have disclosed any compensation or incentives received in connection with your Feedback; and (iii) your Feedback complies with these Terms. We are under no obligation to keep your Feedback confidential, compensate you for it, or respond to it.
We may, at our sole discretion, monitor, edit, or remove any Feedback that we determine to be unlawful, offensive, threatening, defamatory, obscene, or otherwise objectionable, or that violates any party's intellectual property rights or these Terms.
You agree that your Feedback will not infringe on any third-party rights, including copyright, trademark, privacy, or other personal or proprietary rights. You further agree that your Feedback will not contain unlawful, abusive, or obscene content, nor any malicious code. You may not use a false identity or mislead others about the origin of your Feedback. You are solely responsible for any Feedback you submit and for its accuracy.

Occasionally, information on or within the Services may contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability. We reserve the right to correct any such errors and to update information or cancel orders if any details are found to be inaccurate, at any time and without prior notice, including after you have submitted your order.

You may use the Services for lawful purposes only. Additionally, you agree not to: (a) upload or transmit viruses or other malicious code; (b) reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services; (c) collect or track the personal information of others; (d) engage in spamming, phishing, spidering, crawling, or scraping; or (e) interfere with or attempt to circumvent the security features of the Services. We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine that you have violated any part of these Terms.
Section 14 – Termination
We may terminate this agreement or your access to the Services (in whole or in part) at our sole discretion, at any time and without notice. You will remain liable for all amounts due up to and including the date of termination.
The following sections survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive.
Section 15 – Disclaimer of Warranties
The information presented through the Services is provided for general informational purposes only. We do not warrant its accuracy, completeness, or usefulness. Any reliance you place on such information is strictly at your own risk. We disclaim all liability arising from reliance placed on these materials by you, any other visitor, or anyone informed of their contents.
EXCEPT AS EXPRESSLY STATED BY KIKI'S WAY, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" FOR YOUR USE, WITHOUT ANY REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS LIMIT OR DO NOT PERMIT THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE ABOVE MAY NOT APPLY TO YOU.
Section 16 – Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, KIKI'S WAY, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS — INCLUDING SHOPIFY AND ITS AFFILIATES — SHALL NOT BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS OBTAINED THROUGH THE SERVICES, OR FOR ANY OTHER CLAIM RELATED TO YOUR USE OF THE SERVICES OR ANY PRODUCT, EVEN IF ADVISED OF THEIR POSSIBILITY.
Section 17 – Indemnification
You agree to indemnify, defend, and hold harmless Kiki's Way, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims — including reasonable attorneys' fees — arising from or related to (1) your breach of these Terms or any documents incorporated by reference; (2) your violation of any law or the rights of a third party; or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim, though a failure to do so promptly will not relieve your obligations unless you are materially prejudiced. We may control the defense and settlement of such claims at your expense, including the selection of counsel, but we will not settle any claim that imposes non-monetary obligations on you without your consent (not to be unreasonably withheld). You agree to cooperate in the defense of any indemnified claim, including by providing relevant documents.
Section 18 – Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law. The unenforceable portion will be deemed severed from these Terms without affecting the validity or enforceability of the remaining provisions.
Section 19 – Waiver and Entire Agreement
Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
These Terms, together with any policies or operating rules posted on this site or in connection with the Services, constitute the entire agreement between you and us. They govern your use of the Services and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, including any prior versions of the Terms of Service.
Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.
Section 20 – Assignment
You may not delegate, transfer, or assign this Agreement or any of your rights or obligations under these Terms without our prior written consent. Any unauthorized attempt to do so will be null and void. We may transfer, assign, or delegate these Terms and our associated rights and obligations without your consent or notice.
Section 21 – Governing Law
These Terms of Service and any separate agreements through which we provide the Services shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law provisions. You and Kiki's Way consent to venue and personal jurisdiction in the federal and state courts located in New Mexico.
Section 22 – Headings
The headings used in this agreement are for convenience only and do not limit or otherwise affect the meaning of these Terms.

The most current version of these Terms of Service can be reviewed at any time on this page.
We reserve the right to update, modify, or replace any part of these Terms at our sole discretion by posting changes to our website. It is your responsibility to check our website periodically for updates. We will notify you of any material changes in accordance with applicable law, and such changes will take effect on the date specified in the notice. Your continued use of or access to the Services following any posted changes constitutes your acceptance of those changes.
